These Terms of Service (“Terms”) govern your access to and use of the website maryfeldman.com (the “Site”) and all digital courses, materials (not limited to materials downloaded or purchased), programs, content, communities, and services (collectively, the “Services”) offered by Mary Feldman, LLC (“Company,” “we,” “us,” or “our”) through the Kajabi platform.

     

    By accessing the Site or purchasing any Services, you agree to be bound by these Terms.

    IMPORTANT NOTICE — EDUCATIONAL PURPOSE ONLY

    The Services are educational and informational in nature and may address mental health–related topics, emotional well-being, self-reflection, and personal development.

    The Services are not therapy, counseling, medical treatment, diagnosis, or a substitute for professional mental health care.

    Participation does not create a therapist-client, doctor-patient, or other healthcare relationship.


    If you are experiencing distress or need clinical support, please seek assistance from a licensed mental health professional or local emergency services.

    1. Eligibility & Consent

    The Site is intended for individuals 18 years of age or older.

    By accessing the Site or purchasing the Services, you:

    • Represent that you are at least 18 years old

    • Confirm that you have read, understood, and agreed to these Terms

    • Agree to be bound by these Terms whether or not you have read them in full

    If you do not agree, please discontinue use immediately.

    2. Definitions

    • “Site”: “Site” refers to maryfeldman.com and all related pages, tabs and content.

    • “Company,” “we,” “us,” or “our” refers to Mary Feldman, LLC and www.maryfeldman.com

    • “Content”: includes but not limited to all written, video, audio, downloadable, and live materials provided through the Site, newsletter, social media or Kajabi platform.

    • “Services”: All courses, programs, memberships, communities, events, and digital products

    • “You”: The user, purchaser, or participant

    3. Purchases, Digital Delivery & Kajabi Checkout Agreement

     

    By clicking “Purchase,” “Buy Now,” or similar checkout language, you acknowledge that:

    • You are purchasing digital educational content

    • Access may be granted immediately

    • You are not purchasing therapy or medical services

    • Refund eligibility (if any) is governed by the policy stated at checkout

    Prices are listed in [USD/EUR] and payments are processed through Kajabi and its payment processors.

    4. Refund Policy

    Due to the digital nature of the Services and immediate access, all sales are final unless otherwise stated at checkout.

    EU/EEA Consumers

    If you reside in the EU/EEA, you expressly consent to immediate digital delivery and acknowledge that you may lose your statutory right of withdrawal where permitted by law.

    5. Payment Plans & Failed Payments

    If you select a payment plan:

    • You authorize automatic recurring charges

    • You are responsible for completing all payments owed

    • Failed payments may result in suspended or terminated access

    Re-charge attempts and access restoration are governed by Kajabi’s payment systems.

    6. Chargebacks

    If you experience a billing issue, please contact us first so we can help resolve it.

    Unauthorized chargebacks may result in suspended access and additional administrative fees where permitted by law.

    7. Acceptable Use

    You agree not to:

    • Harass, abuse, or harm others

    • Share misleading, unlawful, or infringing content

    • Disrupt platform security or functionality

    • Share login credentials or course materials

    • Use the Services for competitive or commercial purposes without written consent

    8. Intellectual Property & License

    All Content is the exclusive intellectual property of the Company and protected under U.S., EU, and international law.

    You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

    Unauthorized reproduction, resale, or distribution is prohibited.

    9. User Submissions

    By submitting comments, assignments, or other materials, you confirm ownership and grant the Company a non-exclusive, royalty-free license to use such materials for business and educational purposes.

    10. No Guarantees or Results

    We make no guarantees regarding outcomes or results.
    Individual experiences vary, and your results depend on many factors beyond our control. Individual results vary. Past participant experiences do not guarantee similar outcomes.

    11. Assumption of Risk & Personal Responsibility

    Engaging with self-reflective educational content can evoke emotional responses.

    You voluntarily assume responsibility for your well-being and agree that you are solely responsible for decisions or actions taken based on the Services.

    12. Errors & Omissions

    We strive for accuracy but make no guarantees that Content is complete, error-free, or current. You agree to independently verify information as needed.

    13. Disclaimer of Warranties

    The Services are provided “AS IS” and “AS AVAILABLE.”
    To the fullest extent permitted by law, we disclaim all warranties, express or implied.

    14. Limitation of Liability

    To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages.

    Where liability cannot be excluded (including EU consumer law), liability is limited to the amount paid for the Services.

    15. Indemnification

    You agree to indemnify and hold harmless the Company from claims arising out of your use of the Services or violation of these Terms.

    16. Third-Party Links & Platforms

    The Site may contain links to third-party websites. We are not responsible for their content, policies, or practices.

    The Services are hosted on Kajabi, and your use of Kajabi is subject to its own terms and policies.

    17. GDPR & Data Protection (EU/EEA Users)

    If you are located in the EU/EEA, we process personal data in accordance with the GDPR.

    You have the right to access, correct, delete, restrict, or object to processing of your data.

    18. Dispute Resolution & Arbitration

    U.S. Users

    Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association. You waive the right to a jury trial.

    EU/EEA Users

    Nothing in these Terms limits your mandatory consumer rights under applicable law.

    19. Governing Law

    • U.S. Users: Laws of the State of Tennessee

    • EU/EEA Users: Mandatory consumer protection laws of your country of residence

    20. Termination

    We may suspend or terminate access if these Terms are violated. Termination does not entitle you to a refund unless required by law.

    21. Entire Agreement & Severability

    These Terms, together with our Privacy Policy, Disclaimer, and Group Agreement, constitute the entire agreement.

    If any provision is found unenforceable, the remaining provisions remain in effect.
